If I won a lawsuit for a workers comp injury,will my normal insurance pay for medical care?
I was injured on the job (hit by a drunk driver in my police car) and sued the lady that hit me. I won a settlement, but spent the money on bills and paying off debt. I later learned that Workers Comp in Texas won't continue to pay for medical care unless all the money I was awarded was spent on care first. Well, too late now.The money is gone. Now I'm afraid that my own insurance won't cover it either because it's a work-related injury.
So now am I stuck being injured forever?Seems like I should have some recourse.I would appreciate anyone who can give me some advice.

So you was on the job and injured.That is covered under workers comp.Then you sued the person that caused your injuries.When you recieved the settlement from the woman, it should have been divided three ways.A third should have gone to your attorney, medical bills, and you personally.

Looks like you settled too soon.Since you are still recieving medical treatment as a result of the accident.

If normal insurance pays for your medical care, they will get REIMBURSED by the workers comp carrier. You cannot get paid twice for your medical bills, and pocket one payout. That's double dipping, and illegal.

Workers comp should STILL be paying lost wages and medical care that was NOT paid by the driver. But you HAVE been paid for your medical bills and injuries. You just chose to spend the money elsewhere.

If you had not been in the accident, you would have needed to use other money for the "bills and paying off debt". Use that other money to pay the medical bills.
