what did that dumb O bama do with 60 senators and 260 congress democrats in the house-------GHANTA.......he is the most useless guy on earth....

Indians always seem to think Democrats will help them but they are like our Indian politicians only, all promises no action

Come the November Elections, Dems could lose 10 in Senate..

And we are back to square one.

    Dejavu 2007/2008 ;

If this happens, no bill will pa*s, leave alone Immigration Reform.

Republicans will keep sending bills and Obama will Veto 'em.

When there is no solution is to be found for the illegal immigration issue...then the obvious thing to mess with is the legal immigration!Isn't It?;)

Good Job!Kudos to whoever is doing it!:p

Corporate world drives the laws and lobbying. This bill will be in the bin even before you know it.As for the STIVE etc.none will make it as long as they are comprehensive in nature. That said, the relief to the EB segment is coming soon, so sit tight.

That's called pandering. To unions like IEEE and hispanic vote base. These ppl don't have any interest in America's competitiveness or interests of people at large rather work in the interests of their party and their re-election.

But I am suprised at the attitudes of some forums members who want to screw the ppl behind us.
Anyway I agree, we should be worried about delays to i-485 processing if 11 million ppl are added to USCIS queue.

I know where Senator Durbin stands on illegal immigration issue , he is totally for amnesty/legalization of illegal/undocumented people in the country.According to him its ok if someone is totally undocumented and stays here but its not ok if someone does consulting and documented and pays taxes while working and waiting for the green card to be approved.Isn't it height of hypocrosy?

Where do people like mbdriver and senthil stand on the issue of legalization/amnesty for illegal/undocumented people in the country? If the legalization were to happen these are the kind of people who complain saying illegal aliens have slowed down our green card petetions. If legalization were to happen processing of every petetion at USCIS will slow down considerably.I will not surprised if 485 takes 4.85 years or 48.5 years or 485 years ...:)

Which one is a bigger problem 12 to 15 million people totally undocumented or perceived misuse of visa petetions by few bad apples.

On the other hand if some one is attacking me in my home and/or hurting my family or freinds, I have full rights to defend and call for justice to prosecute the attacker, in this case declaring Pakistan a terrorist country.

So you don't consider Kashmir as part of your home.Majority of Indians think Kashmir is part of India.

Where does the boundary of your little world end?I know the boundary starts with you.How big is that world ?

It is so enlightening to learn that you care for people other than yourself.

I am on H1 since 1999 with same employer except for a long interval of 16 months.I filed my labor in April 2001 (a*suming 245(i) will cover me).I was not on payroll during Aug 03 to Dec 04.So my W2 for 2003 is 33% less than LCA and no W2 for 2004.I last entered US in Sept.03
I filed my I-485 in June 07.I-140 was approved under PP.
My question is that what are my chances of being approved?
Also is there anything I can do now to rectify it?
I have no issues with the employer. He is willing to help me out in any way.
    Thanks a lot

I tried looking for the baltimore case but I don't have it on this computer. You might want to search for it on immigration.com.

That case had a lot more things in it.

    1) person never worked at the location as specified by the greencard labor
    2) person acknowledged he wasn't going to work there upon greencard approval
    3) person was claiming ac21 within same employer for different location

Administrative appeals office; concurred that ac21 wasn't specific to geographic location and didn't have to be done with another company; it could be done within same company.

Then AAO went another way and picked on some other issues: Other issues they picked on was information on his g-325a and his work locations. They picked onthat he didn't have h-1b's approved for those particular locations or LCA's and he was out of status.he was good on the ac21 but was out of status prior to filing 485.

But in the Baltimore case, AAO was questioning that the beneficiary never resided in the state his H1 was petitioned for...But I wonder, shouldn't that be allowed as long as the place of work remains the same...I mean, let's say, if I work work in NY and live in NY, then as per AAO, it's fine. What if I work in NY (same location) and live in NJ, then it's not ok as per AAO?What if I can commute even longer distances dailiy, like living in Philly and commuting to DC, etc.?May be that's the reason why AAO directed the local office to give the petitioner a chance to provide any such evidence?

Yea your calculation is a little off.400,000 financed @ 5% 30 year fixed is $2,148.Factor in your taxes and insurance in escrow thats a total of (approximately, im guessing for your area) $2,500 total.Plus your HOA of $250/month thats 2750 which sounds about right with gapala's calculation.Your closing costs, give or take should also be factored, approx.10-30k.

So that comes to 33k/yoy in expenses. That may not be bad when your making six figure incomes or combined household incoming is 150K+, since 20k+ of interest is deductible yoy, but imo i wouldnt buy a 500k+ property unless there is some sort of income to bring down my monthly cost, like a rental unit.

Townhouses here in NY are very similar to condos so I'm a*suming that its the same there.I personally would not pay 500k for something similar to a condo unless its in Manhattan.Just curious why not buy a house instead of a townhouse?Unless thats the norm in that area.I would prefer to take care of the house myself than pay maintenance and HoA dues. You learn a lot more and grow as a homeowner.

Sorry and thanks for the correction....I missed the closing costs...
but from what I know it is 1% of the home price ?so around $ 5000.(again not sure)

as for the calculation....I did not take into consideration the principle....as that is not an expense.....

as someone said earlier...no calculation might make sense if prices keep falling down...

As I said ...Is there risk invloved...?of course yes -;)

We are looking to buy a house and the bank is asking us to put down 10%.How much money is considered safe to have after down-payment if we are buying a home.I know it depends on the situation, but I would like some estimates/ball-park figures.
if on EAD / H1 - have atleast 12 months living expenses (food, mortgage, utilities taxes etc ..for worst case scenario - maybe even more -- since you won't be able to sell the house easily if you have to move for a new job) ..if on GC, I guess 6 months.depends on yr area, skills etc ..my guess only.
here is the latest from Wachovia ..(I know it is a repeat ..but to answer the original thread question for others who may want opinions) ..These economists are generally optimistic even when the situation is bad (since it hurts their own stock prices) ..the fact that they are pessimistic shows the real situation. In other words (my thoughts) - if your 485 is pending, then there is no hurry to buy a house ..deals will get better in the next 18 months.(after that house prices will be stagnant for a longer time -- this is for most locations or around 95% of US cities/towns)
    ------------
Don Truslow, chief risk officer of banking giant Wachovia (WB, Fortune 500), said home prices should fall through 2008 before finally hitting bottom in the middle of 2009.(Wachovia, the No.4 U.S.bank by a*sets, reported an unexpected loss Monday.)

Sinai argues that until housing prices turn around, there isn't much hope for a pick-up in the economy because housing woes will continue be a drag on consumer spending and the credit markets.
"So much borrowing and lending was leveraged to [housing], that as long as values keep going down, the exposure of consumers, of financial institutions and of investors remains extremely high," he said.
    -----------
if you are technical person ..read this article ..not sure how he (Mr.Makin is a visiting scholar at the American Enterprise Institute.)comes up with 23% figure ..but I guess he must have done research.

As average house prices plummet declining at a 23% annual rate over the three months ending in January lenders are sharply curtailing access to mortgage-based, home-equity loans. The 15% of U.S.mortgage holders with negative equity in their homes have no access to credit, and 20% with marginal equity have limited access at best.Overall access to credit is contracting: Ask Americans trying to utilize home-equity lines or arrange student loans.

    Ghazni's best-kept secret - The Indian Express
    S.C.Sharma ()
    April 25, 1998

    Title: Ghazni's best-kept secret
    Author: S.C.Sharma
    Publication: The Indian Express
    Date: April 25, 1998

Provocative Ghauri was the title of an editorial that appeared
on this page earlier this month.Pakistan has named its missiles
Ghauri and Ghaznavi with the specific intention of taunting
India. These worthies' claims to fame and glorification, in the
perception of the Pakistanis, lies in the fact that they were
credited with plundering and devastating north-western India time
and time again in the eleventh and twelfth centuries.

In their enthusiasm to score brownie points, the Pakistanis have
got mixed up on chronology, they have produced Ghauri before
Ghaznavi. Also, they have perversely sought to commemorate these
Afghan rulers of Turkish descent in utter disregard of the fact
that most of the territories they plundered are their own - the
North West Frontier Province, the Punjab and Sind. The men and
women they tortured, enslaved, ravished and put to the sword were
    their own forebears.

If Pakistanis wish to revel in the inglorious misdeeds of
foreigners perpetrated on their own soil and on their own
ancestors, they are welcome to twirl their moustaches in euphoria
and say: " Where ignorance is bliss, it is folly to he wise."

Indians may look forward to future generations of Pakistani IRBMs
and similar sophisticated weaponry named after the likes of
Changez Khan, Nadir Shah and Ahmad Shah Abdali.Alexander the
Great and Harshavardhan also have strong claims, but they might
    be disqualified for obvious reasons.

In the course of his many abortive forays into India, Mohammad
Ghori is said to have been captured once by the forces of Delhi.
But Prithviraj Chauhan, king of Delhi, magnanimously let him off.
Legend has it - and it is widely believed in India - that when
Ghori eventually succeeded in defeating Prithviraj Chauhan at the
Second Battle of Tarain in 1192, he blinded him and took him in
chains to Afghanistan along with his friend, the poet
    Chandravardai.

Ghori held a grand durbar to celebrate his victory. His prize
catch, the king of Delhi, blind and a prisoner, was paraded and
publicly humiliated.Deeply incensed by the treatment meted out
to his monarch, Chandravardai took refuge to a subterfuge. He
announced that though completely blind, Prithviraj could still
hit a target guided solely by sound, and he asked for permission
for this feat to be performed.

Prithviraj Chauhan was handed a bow and arrow, and Chandravardai
sang a now-famous verse which told him of the elevation and
distance to Ghori's throne. And thus, guided solely by sound,
Prithviraj shot his arrow through Ghori.

The legend may not be entirely true, but it would be absolutely
accurate to say that even after eight centuries have elapsed,
Prithviraj is regularly subjected to indignity in the land where
he was taken as a captive.I have seen it at first hand.

Many years ago, while travelling by jeep from Kandahar to Kabul,
I had to make a night halt en route at Ghazni. At the hotel, I
learned that there was a grand mausoleum over the tomb of Sultan
Mahmud Ghaznavi near the town, and I determined to see it.A few
extra Afghanis (the local currency) helped my driver to
comprehend the necessity of making a small detour the next
    morning.

The mausoleum was indeed grand -judging by local standards - with
a high, arched doorway like the Buland Darwaza.lie tomb proper
was in a cellar about four or five feet be low ground-level.It
intrigued me considerably to note that there were no steps
leading down into the tomb.Instead, a metal chain hung from the
ceiling of the cellar.I was told that I would have to hold the
    chain and jump down.

I asked for the reason for this peculiar method of entry. The
caretaker was evasive at first. But after much persuasion, he
disclosed that there was another tomb at the exact spot where you
jumped down. There, the infidel king of Delhi, Prithviraj
    Chauhan, lay buried.

    ================================================== =====================
Might I add, that the very Islam these Pakis seem to be proud of, was forced down upon them.
Most of these are descendents of forced converts to Islam!

Agree.Like labor subsitution scandal/abuse, you should have a documenterly evidence to go after this scam (creating duplicate EB2 job just to cut-short the line). If it is a USCIS rule, they may ripoff this ( like labor sub.).It is long way to go.The nut shell-- as long us GC is in high demand, people abuse the system.DOL, USCIS, knows this.Thatswhy DOL is auditing most EB2 labor certification. In my view, who ever filed EB2 between 2000 to 2004 (when EB3 was current) are true-EB2.After 2005, most of the EB2 filings are cut-short the EB3 que. Most of the cases not based on actual MINIMUM requirements for the job.Everyone knows this..

Please stop with this.this is truly offensive. Many of us happen to be truly qualified beyond your clarly limited imagination. Not all of us are in IT, not all of us work in body shops and NOT all of us deal with fraud in our lives. If a few do, then go chase the, and stop tarring us all with the same brush. This is really akin to my saying (and I'm not saying it) that all EB3 folks are just IT diploma holders working for body shops and the wh*le category is just a fruad. How does the tarring feel now?

ok now i'm really confused between AC21 and future employment debate....
AC21 can be used after 6 months of 485 filing to change the job but then once u get GC you have to work for the original company that filed your 485 for few months??so for e.g.if i change my job after lets say 1 year of 485 filing and lets say my 485 is approved after 3 years so now do i have to quit my new job and go back to my old employer to work for few months to get my gc?am i understanding this correct?i think i'm not...can you please clarify??thnx

    Hi United Nation,

If AC21 is so difficult to use what about EAD??Is all these apply to EAD too??
